Terms of Service
These terms govern your use of odyscars.com ("Odys Market"). By creating an account or using the site you agree to them. If you do not agree, please do not use the site.
What Odys Market is
Odys Market is an advertising platform that lets sellers list used cars and lets buyers find and contact them. We are not a party to any sale. We do not own, inspect, or take possession of any vehicle advertised here, we do not handle payment between buyer and seller, and we give no warranty about any vehicle, seller or buyer. Any contract for the sale of a car is between the buyer and the seller alone.
Your account
You must be at least 18 and provide accurate registration details. You are responsible for keeping your password secure and for everything done through your account. You must verify your email address before you can publish a listing, upload photographs or send messages. Tell us promptly if you believe your account has been compromised.
Listings
You may only advertise a vehicle you own or are lawfully authorised to sell. You must:
- describe the vehicle accurately, including its mileage, condition and history;
- use photographs of the actual vehicle, which you own or have the right to use;
- state a genuine asking price;
- keep the listing up to date and mark it as sold when it sells;
- comply with Irish consumer law, which places additional obligations on trade sellers.
If you are selling in the course of a business you must register as a dealer rather than as a private seller. Misrepresenting a trade sale as a private one is a breach of these terms and of consumer protection law.
What you may not do
- Post false, misleading, fraudulent or duplicate listings.
- Advertise anything other than a vehicle genuinely for sale.
- Use the messaging system to send spam, scams or unsolicited advertising.
- Harass, threaten or abuse other users.
- Scrape, bulk-download, or systematically copy listings or user data from the site.
- Attempt to gain unauthorised access to the site, other accounts, or our systems.
- Upload malware, or content that infringes anyone's intellectual property rights.
Price insights are an estimate, not advice
Odys Market shows a price indication on listings, produced by a statistical model trained on historical Irish used-car advertisements. It reflects asking prices observed in the market, not sale prices, valuations or appraisals. It may be wrong, particularly for unusual, modified or rare vehicles. It is provided for information only. Do not rely on it as a valuation, and always inspect a vehicle and carry out your own history and mechanical checks before buying.
Where we display road tax, NCT or vehicle history information, it is derived from data supplied by the seller or by third parties. We do not guarantee its accuracy or completeness.
Your content
You keep ownership of the listing text and photographs you upload. By posting them you grant us a non-exclusive, royalty-free licence to host, display, resize and distribute them for the purpose of operating and promoting the marketplace. This licence ends when you delete the content, save for copies retained in backups or where we must keep a record.
Moderation
We may remove a listing or message, or suspend or close an account, where we reasonably believe these terms have been breached, where content is unlawful, or where it is necessary to protect other users. Where practical we will tell you why. You can report a listing or a user to us from the site.
Cost
Odys Market is currently free to use for both buyers and sellers. If we introduce charges we will give reasonable notice before they apply to you, and no charge will ever apply to a listing you have already published without your agreement.
Availability
We aim to keep the site available but we do not guarantee uninterrupted service. We may change, suspend or withdraw features, and we may take the site down for maintenance. Listings do not run indefinitely; a listing expires after a period, and we will email you before it does if you have not turned those notifications off.
Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited — including your rights as a consumer under Irish law, which these terms do not affect.
Subject to that, we are not liable for any loss arising from a transaction between users, from the condition or description of any vehicle, from your reliance on a price indication, or from any indirect or consequential loss.
Ending your use
You may close your account at any time from your account settings. We may close your account if you seriously or repeatedly breach these terms.
Changes
We may update these terms. We will change the date at the top of this page, and where the change is significant we will tell you by email before it takes effect. Continuing to use the site after that means you accept the new terms.
Governing law
These terms are governed by the law of Ireland, and the Irish courts have jurisdiction over any dispute. Your data is handled as described in our Privacy Policy.
